Terms of Use
These terms govern your use of deltabeam.ai and the demo request form. They do not govern Metareview, our product, which is invite-only and covered by a separate agreement. By using this site, you agree to these terms.
1. Who these terms are with
This site is operated by Deltabeam (“Deltabeam,” “we,” “us,” “our”). These terms are an agreement between you and Deltabeam. If you use the site on behalf of an organization, you confirm you are authorized to accept these terms for it. You must be at least 18 to use the site.
2. The site is informational
Everything on this site is for general information about Deltabeam and our work. Statements about future capability, performance, or direction are goals, not guarantees. Nothing here is an offer, and access to the site is not a promise of access to any product. We may change, suspend, or withdraw any part of the site at any time.
3. No engineering advice
Deltabeam is a technology company, not a licensed engineering firm, and we provide software, not professional engineering services. Nothing on this site is professional engineering advice, a professional opinion, a certification, or an approval, and nothing here creates an engineer-client or other professional relationship. A licensed professional engineer remains in responsible charge of, and solely responsible for, any design, review, analysis, or decision. Do not rely on anything on this site in connection with the design, construction, or safety of any structure.
4. Our software’s output
Our software reviews structural drawings and flags potential discrepancies against the design of record for a licensed engineer to act on. It is a reviewing tool: it does not perform an exhaustive or certified review, does not determine code compliance or the accuracy of dimensions, quantities, or fabrication details, and does not stamp, seal, certify, or approve any document. The engineer of record retains responsible charge and is responsible for reviewing and confirming its findings before relying on them. Descriptions of the product on this site show what it does; they are not a warranty of any particular result.
5. Acceptable use
You agree not to:
- scrape, crawl, or harvest the site by automated means, other than well-behaved search crawlers that honor our robots directives;
- copy, reproduce, or redistribute site content beyond your own evaluation of Deltabeam;
- reverse engineer or attempt to derive the source, structure, or underlying models of any interactive feature;
- submit the demo form using a false identity, someone else’s information without authority, or automated or bulk submissions, or otherwise misuse it to send spam or unlawful content;
- probe or test the security of the site, or bypass any access or rate-limiting control;
- use the site to break the law or infringe anyone’s rights, or interfere with its operation or with others’ use of it.
6. Demo requests
If you submit the demo form, you confirm the information is accurate, is yours or your organization’s to share, and that you are authorized to submit it. We handle it as described in our Privacy Policy.
7. Intellectual property
The site and its content (text, graphics, logos, imagery, video, code, and the interactive visualizations) are owned by Deltabeam or its licensors and are protected by intellectual-property laws. You may view and use the site for your own informational, non-commercial evaluation; no other rights are granted. “Deltabeam,” “Metareview,” and “Navier,” together with the Deltabeam logos, are our trademarks, and you may not use them without our prior written permission except to refer to us accurately.
8. Third-party links and services
The site links to other sites (including metareview.deltabeam.ai) and relies on third-party services to operate. We are not responsible for third-party sites or services, or their content or terms; your use of them is at your own risk and subject to their own terms.
9. The site is provided “as is”
The site and everything on it are provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by law, we disclaim the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and any warranty that the site will be uninterrupted, secure, error-free, or free of harmful components. This includes any output produced by our software.
10. Limitation of liability
To the fullest extent permitted by law, Deltabeam’s total liability to you for all claims arising out of or relating to the site or these terms will not exceed one hundred US dollars ($100). We will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or business opportunities, even if advised of the possibility. Nothing in these terms limits any liability that cannot be limited by law, including for gross negligence, willful misconduct, or fraud.
11. Indemnification
You agree to indemnify Deltabeam against claims, losses, and expenses arising from your misuse of the site or your breach of these terms or of anyone else’s rights.
12. Changes to these terms
We may update these terms from time to time. We will change the date at the top when we do, and your continued use of the site after a change means you accept the updated terms.
13. Governing law
These terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. The state and federal courts located in Delaware have exclusive jurisdiction over any dispute arising out of or relating to the site or these terms, and you consent to venue there. If you use the site from outside the United States, you are responsible for complying with your local law, and some mandatory local protections may still apply to you.
14. General
If any provision of these terms is unenforceable, the rest stays in effect. Our not enforcing a provision is not a waiver of it. You may not assign these terms; we may assign them to a successor or affiliate, including on incorporation or in connection with our business. These terms, with the Privacy Policy, are the entire agreement between you and Deltabeam about the site.
